E-2 Treaty Investors

The United States immigration policy supports investment and commerce in a variety of ways. The E-2 visa is appropriate for individuals who come to the United States to make a substantial investment in a new or existing enterprise. These individuals are known as "treaty investors."

Who can apply?

Any national of a country with which the United States has a treaty of commerce and navigation (known as "treaty country") can apply for an E-2 visa. Certain employees of a "treaty investor" may also be eligible for this visa. Advantages and disadvantages of an E-2 visa:

One of the biggest advantages of an E-2 visa is that there is no minimum investment amount required as long as it is substantial, i.e., it is sufficient to develop a successful, non-marginal business. Also, the spouse of an E-2 visa holder can apply for work authorization. Unmarried children under 21 of an E-2 visa holder will also be issued an E-2 visa and can attend school in the United States.

The downside of an E-2 visa is that the treaty investor can only work for the business on the basis of which the E-2 visa is issued. Also, the business should be continually successful, or the visa can be denied. Children who are over 21 or reach the age of 21 years, must apply for a different visa to continue their stay in the United States.
